Can you put out-of-state property into your trust?
Introduction
If you own multiple real estate in different states, you might wonder if you could create a trust in one state and manage to put all real estate located in different states into that one trust. It is possible to do this, which is one of the benefits of creating a trust.
 
How to place out-of-state property into your trust
If you wish to place any real estate into your trust, you will need to legally transfer it into the trust. To do so, you will prepare a deed to transfer title of the real estate (that is likely to be in your name or under joint ownership between spouses) to the trustee of your trust. If you prepare your trust in the State of Hawaii but you own a real estate in the State of Nevada, you can hire an attorney or a deed preparation company in the State of Nevada to prepare a deed in that state, that will help transfer title of the real estate from the current owner to that of the trustee of the trust created in the State of Hawaii.
 
Benefit of placing out-of-state property into your trust
Generally, you will need to open a separate probate for each state in which any real estate that you owned during your lifetime is located. If you own a number of real estate in different states, you might need to open several different probates once you die, if you did not put your multiple real estate into a trust during your lifetime. Thus, preparing a trust and putting any real estate that you own into such trust will help you avoid the possibility of opening several probates in different states, once you die.
 
Conclusion
Given the foregoing benefit of being able to avoid multiple probates, it might be a good idea to prepare a trust in the event that you own several real estate in different states.

Meet Yuka Hongo, Esq.
Yuka Hongo is a respected estate planning attorney based in Honolulu, Hawaii. She has practiced law for 10 years and is fluent in both English and Japanese.
 
Practice Areas: Yuka represents clients in matters relating to estate planning/administration, including probate and the preparation of transfer on death deeds. In addition, she assists clients in forming captive insurance companies in the State of Hawaii, and performing the corporate maintenance work on an ongoing basis for such companies.

Education: In 2000, Yuka graduated from Oberlin College (Oberlin, OH), where she earned a Bachelor of Arts Degree in Economics and East Asian Studies. In 2004, she graduated from Loyola Law School (Los Angeles, CA), where she earned her Juris Doctor Degree.

Multicultural Background: Yuka has experience living and working in both the U.S. and Japan and has a thorough understanding of both cultures and the people who live in both countries.
